Workweek Definitions and Overtime Eligibility

As a general guideline, overtime is paid when the employee has worked in excess of their normal hours scheduled in the workweek. Titles within the CWA, IFPTE, PBA and FOP are part of a compensation plan which designates eligibility for overtime and compensatory time. Normally scheduled overtime must be approved, in advance, by the supervisor. Detailed information regarding overtime and exceptions to this general overview may be obtained from the applicable union contract, employee handbook, or by contacting Human Resources directly.

  • Fixed (35 or 40 hour) Workweek Employees: Employees serving in job titles assigned specific workweek limits of 35 or 40 hours are entitled to be compensated for hours worked in excess of their normal workweek. This compensation may be cash at one and one-half times the regular hourly rate or compensatory time at one and on-half times the hours worked.

  • NE (Non-Exempt) Workweek: Employees who work hours in excess of 35 but not more than 40 receive no cash compensation. Employees are eligible to receive compensatory time earned hour for hour. For hours worked in excess of 40, cash compensation at one and one-half times the regular hourly rate or compensatory time at one and one-half times the hours worked will be paid.

  • NL (No Limit) Workweek: Employees who work in excess of 35 hours are not entitled to cash compensation. Employees are eligible to receive compensatory time, earned hour for hour, for work performed on recognized/authorized holidays only. Excess hours worked during normal 35 hour workweek schedule are ineligible for compensatory time earnings. Management Employees (Salary Range D20 to D29): Those provisions explained above for bargaining unit staff will apply. Time earned must be used within the fiscal year.

  • Management Employees (Salary Range D30 and Above): Employees in this category work schedules approved by their supervisors and are not eligible for compensatory time on Saturdays and Sundays. They are, however, entitled to comparable time off on another work day approved by their supervisor if they work on a State holiday. Managerial Employees can carry up to 60 hours of Compensatory time into the new fiscal Year. Compensatory time is not payable at termination.
